Competition is good, but wouldn't this really put insurance under the commerce clause? It would then be interstate commerce.

I like the first one, competition is always good for the consumer. I don't feel as good about the second. I can see that growing into more government involvement. That is, if I understand it correctly.

I'm not sure I understand the need for the compact but I definitely like the idea of insurance companies being able to sell across state lines. That will help bring down cost.

According to the national group pushing for this, there are already many compacts in operation. However, I suspect you feel the same way I do. There is still a little too much government involvement here for me to be very comfortable.

I apologize. I can see from your question that I didn't explain that concept very well at all. According to the national organiztion pushing for the compact, if the compact is approved by congress any decision made by compact members has the weight of federal law. The idea being that it is equivalent to congress making the decision. So, it doesn't actually supersede federal law, it simply makes an equivalent law for the compact.

Well, I don't know why they think state law can supersede federal law. I mean, state law can add to federal law, but it can't nullify it (that was solved in 1865). I'm no fan of Obamacare, but I'm fairly certain the Constitution says that in cases where state and federal law conflict, federal always wins, yes?

And don't get me wrong, I want to see how well this works. We know that competition generally drives down prices (Wal-Mart is a fine example of that), so hopefully it will work with insurance as well.

It will be interesting to see how this plays out although I am a little leery about the compact idea for fear that it will spread from there. Of course I haven't looked into this legislation so I am not well enough informed about it. I do like the first one, insurance companies should be allowed to cross state lines and the competition would drive the costs down.
